The interests of family members, creditors, and beneficiaries must be addressed. The paperwork is often complicated, and court procedures can be lengthy and time consuming. Mr. Cassady helps clients determine appropriate charges to and payouts from estates and trusts.

At Cassady Law Offices, we also guide clients in efficient estate administration by helping them make choices based on the value of the estate. We take time to explain what options are available in estate administration for estates of various levels of complexity, such as:

  • Affidavit of entitlement — If the estate in probate has a value of $20,000 or less and does not include any real property, you may be able to use this relatively simple procedure. You must be entitled to receive assets of the estate, either because you are named in the will or, if there is no will, through the rules of intestate succession. In other cases, you may still qualify if certain notice requirements are met.
  • Set aside — Estates valued at $75,000 or less can have assets "set aside" without formal administration. This procedure includes filing a petition with the court and a single hearing, and the process can usually be completed within 30 days if no additional issues arise.
  • General probate administration — For most estates valued over $75,000, general probate administration is required. The process includes appointing a personal representative, notifying creditors, liquidating estate assets, reviewing creditor claims, approving estate management, and distrusting assets to heirs.
  • Summary administration — In some circumstances, estates of $200,000 or less may qualify for the summary administration process. This is formal probate but with some processes abbreviated — for example, the creditors' claim period is shortened from 90 to 60 days.
